ASUNTO: Recurso de alzada contra la Resolución de 13 de marzo de 2012, del Director Gerente del Servicio de del Principado de Asturias, por la que se convoca concurso oposición para el acceso a 448 plazas de personal estatutario de la categoría de ATS/DUE del Principado de Asturias publicada en el BOPA nº 62 del 15 de marzo 2012.

Que por el presente escrito y dentro del plazo legal establecido al efecto, conforme a lo dispuesto en el artículo 35.1 de la Ley 1/1992, de 2 de julio, del Servicio de Salud del Principado de Asturias, en relación con el artículo 27 de la 2/1995, de 13 de marzo, sobre Régimen Jurídico de la Administración del Principado de y el artículo 114 y siguientes de la 30/1992, de 26 de noviembre, de de las Administraciones Públicas y del Procedimiento Administrativo Común., viene a interponer RECURSO DE ALZADA previo a la jurisdicción contencioso-administrativa contra dicha Resolución, recurso que fundamenta en las siguientes:
ALEGACIONES
En la Resolución de 13 de marzo de 2012, del Director Gerente del Servicio de del Principado de Asturias, por la que se convoca concurso oposición para el acceso a 448 plazas de personal estatutario de la categoría de ATS/DUE del Principado de Asturias publicada en el BOPA nº 62 del 15 de marzo 2012 dice:
Anexo I BASES REGULADORAS DEL PROCESO SELECTIVO, segunda.: Requisitos de los aspirantes:
f) No poseer plaza en propiedad en la categoría de ATS/DUE, como personal estatutario fijo en el Servicio de Salud del Principado de Asturias, cualquiera que sea su situación administrativa.
La redacción de la base f) viene a contradecir el Estatuto Marco del personal estatutario de los Servicios de Salud Ley 55/2003, de 16 de Diciembre en el Artículo 29. Criterios generales de provisión:
La provisión de plazas del personal estatutario se regirá por los siguientes principios básicos:
a) Igualdad, mérito, capacidad y publicidad en la selección, promoción y movilidad del personal de los Servicios de Salud.
Efectivamente, se limita ese criterio a los propietarios Asturianos sin embargo al no mencionar los propietarios de otras comunidades, ateniendo a criterios de igualdad, deja la puerta a que sí puedan concursar en esta oposición propietarios de otras comunidades.
Son varias las comunidades, que en oposiciones recientes, limitan el acceso solo a personal que NO tenga plaza en las administraciones públicas en la misma categoría. No solo porque para ellos existen los concursos de traslados sino porque deja la puerta abierta a que acumulen en propiedad la plaza de origen y la nueva plaza en esta oposición, restándoles oportunidades a los enfermeros interinos, eventuales o parados:

-Boletín Oficial de la Comunidad de Madrid - Núm 29 RESOLUCIÓN de 29 de enero de 2008, de la Dirección General de Recursos Humanos de la Consejería de Sanidad, por la que se convocan pruebas selectivas para el acceso a la condición de personal estatutario fijo en plazas de Diplomados Sanitarios/Enfermera del Servicio de Salud de la Comunidad de Madrid. f) No poseer plaza en propiedad en la categoría de Diplomado Sanitario/Enfermera como personal estatutario fijo, cualquiera que sea su situación administrativa.
Y la resolución que excluye a casi 500 propietarios: -LUNES 9 DE MAYO DE 2011 B.O.C.M. Núm. 108 Pág. 30 RESOLUCIÓN de 4 de mayo de 2011, de la Dirección General de Recursos Humanos del Servicio Madrileño de Salud, por la que se procede a la exclusión de aspirantes del proceso selectivo para el acceso a la condición de personal estatutario fijo en plazas de Diplomados Sanitarios/Enfermera del Servicio de Salud de la Comunidad de Madrid, por incumplimiento de requisitos.
En mérito a lo expuesto,
